If it's got 7500 miles or more it doesn't matter. I think 2012 models are 50-state emmissions compliant.

Ask the seller check the emmissions label on the frame. Usually it's under the seat on late madel BMW models. The label should read that the vehicle conforms to California regulations, or that it is legal for sale in California.
